Employers cannot pay or employ apprentices at "apprentice rates" on public work contract in New York State, unless apprentices are registered by the construction employer with the New York State Department of Labor.
Enrollment in a course or training program provided by ABC's Construction Training Centers of NYS, does not register the apprentice or your firm with the New York State Department of Labor.
Apprentices are registered with New York State ONLY when:
- The contractor has individually registered the apprentice program, by executing a NYSDOL Apprentice Training Program Registration Agreement (AT 10) for a specific trade and identifies the initial apprentice(s) with the New York State Department of Labor, and
- The contractor has NYSDOL approved apprentice training agreements (AT 401) between each apprentice, the contractor and the New York State Department of Labor, signed by the NYSDOL Director of Apprenticeship & Workforce Development

Apprenticeship Training Requires:
- On the Job training, supervised and mentored by one or more skilled craft workers, requiring both an employer and employee commitment of at least 2000 hours per year, and
- Classroom (related instruction) training of at least 144 hours of instructional class time per year for the duration of the program, depending on the trade.
ABC will help members to:
- Assess needs relative to worker's skills and owner requirements
- Identify trade and respective outline
- Identify and/or Recruit Apprentice
- Assess individual employee's skills for award of credit and placement,
- Confirm availability of Related Instruction
- Submit application for registration through NYSDOL
