ABC will continue to fight against the blatant exclusion of well-qualified contractors from public works contracts


ABC is encouraged by the New York Court of Appeals’ decision on our challenge to the 2008 Amendments to the wasteful Wicks Law.  In a victory for ABC, The Court has drastically narrowed the scope of the apprenticeship requirements imposed by the 2008 Amendments.  The Court also remanded the case for further proceedings to determine whether those exclusionary apprenticeship requirements as part of a Project Labor Agreement are unconstitutional.

We look forward to continuing to litigate the matter on remand on behalf of our members, our partners in bringing this action, and contractors across the State.  ABC will continue to fight against the blatant exclusion of well-qualified contractors from public works contracts.  Such exclusions are particularly unconscionable when they drive up costs to municipalities and taxpayers, and result in lower-quality work, at higher cost.  All contractors should have a fair chance and stand on equal ground in public contracting.  We will continue to press this fight, and work against the various laws, such as this one, that are anti-quality, anti-business and anti-taxpayer.
