ABC Files Suit Against DOL’s Overreaching ‘Persuader Rule’

Associated Builders and Contractors (ABC), ABC of Arkansas and a coalition of stakeholders announced today they have filed a joint lawsuit challenging the final “persuader rule” issued by the U.S. Department of Labor (DOL) on March 24, 2016. Construction Industry Voices Concerns with Silica Rule

The Construction Industry Safety Coalition (CISC) has concerns with the final rule on respirable crystalline silica released today by the Occupational Safety and Health Administration (OSHA). It appears, upon initial review, that the 1,772-page final rule contains some of the same problematic provisions that the CISC previously identified and shared with the agency. 5th Circuit Court of Appeals Hears ABC Challenge to NLRB’s “Ambush” Election Final Rule

ABC’s General Counsel, Maury Baskin of Littler Mendelson, Washington, D.C., argued against the National Labor Relations Board’s (NLRB) controversial “ambush” election final rule on March 3. Baskin argued against the rule, also known as Representation-Case Procedures, in the 5th Circuit Court of Appeals, New Orleans, La. on behalf of ABC of Texas, the Central Texas Chapter of ABC and the National Federation of Independent Business (NFIB). ABC Issues Statement on Erie County "State of the County"

During his State of the County address last evening, County Executive Poloncarz mentioned several times that everyone in the community should benefit from the gains made in the region over the past few years.  It's highly ironic he took this position when many of his construction related policies discriminate against local contractors.

ABC Urges House Appropriators to Roll Back Job-Killing Regulations

On Feb. 17, ABC sent a letter to the U.S. House of Representatives Committee on Appropriations Subcommittee on Health and Human Services, Education, and Related Agencies Chairman Tom Cole (R-Okla.) and Ranking Member Rosa DeLauro (D-Conn.) expressing concern over several regulations issued by the U.S. Department of Labor (DOL) and the National Labor Relations Board (NLRB).

DOL Releases Guidance Defining Joint Employment

On Jan. 20, the U.S. Department of Labor (DOL), Wage and Hour Division Administrator David Weil released a detailed Administrator’s Interpretation (AI) and related guidance on the definition of joint employment under the Fair Labor Standards Act (FLSA) and the Migrant and Seasonal Agricultural Worker Protection Act (MSPA).  The new DOL guidance comes on the heels of recent, controversial expansion of the joint employer definition by the National Labor Relations Board (NLRB) and the Occupational Safety and Health Administration (OSHA). ABC Lauds Bill to Increase Competition on Federal Construction Contracts

Associated Builders and Contractors (ABC) today applauded the House Committee on Oversight and Government Reform’s favorable reporting of
the Government Neutrality in Contracting Act (H.R. 1671) out of committee. The bill, introduced by Rep. Mulvaney (R-S.C.), will increasefair and open competition on federal and federally funded construction projects by preventing federal agencies from requiring contractors to sign project labor agreements (PLA) as a condition of winning federal or federally assisted construction contracts.
