Associated Builders and Contractors Files Suit Against ‘Blacklisting’ Rule

Associated Builders and Contractors (ABC) and its ABC Southeast Texas Chapter announced today that they have filed a lawsuit challenging the Fair Pay and Safe Workplaces final rule, commonly referred to as the “blacklisting” rule, which was released Aug. 25, 2016. The legal challenge was filed in the U.S. District Court for the Eastern District of Texas, Beaumont Division, by the Texas office of Littler Mendelson, P.C., ABC National’s general counsel. The firm will represent ABC, the ABC Southeast Texas Chapter and the National Association of Security Companies (NASCO) in the lawsuit. Read the rest of entry »

Associated Builders and Contractors Applauds Passage of House Bill to Delay Overtime Rule

Associated Builders and Contractors (ABC) today applauded the U.S. House of Representatives passage of legislation that would delay implementation of the U.S. Department of Labor (DOL) Wage and Hour Division’s costly and burdensome final overtime rule. The bill, the Regulatory Relief for Small Businesses, Schools, and Nonprofits Act (H.R. 6094), passed the House with bipartisan support by a vote of 246-177 on Sept. 28.

ABC Files Suit Against DOL's Overtime Rule

Statement from Joshua Reap of Associated Builders & Contractors Regarding Remarks Made in 54th Senate Race “What’s become abundantly clear is that Pam Helming’s Albany and downstate handlers, those funding her campaign, have great concerns about her ability to win this election. And instead of promoting her positives they instead choose to tarnish our organization and Floyd Rayburn.The statement made by this mail piece is inaccurate, tasteless and serves as a deflection from a critical issue: the need for skilled workers in construction. The majority leadership in Albany has failed to do enough to promote merit shop construction trades as a viable, well-paying, middle-class career choice for students coming out of high school. Finding no help from Albany, our association joined other national organizations to petition Congress for better resources to help stop unwarranted hiring of illegal immigrants, while at the same time calling for the construction industry to have a higher cap to the number of slots allocated in an already existing temporary worker program. It did not then, nor does it now, call for amnesty.

ABC, AIA and NAHB Economists Predict Industry Growth Through 2017

Associated Builders and Contractors (ABC) Chief Economist Anirban Basu, American Institute of Architects (AIA) Chief Economist Kermit Baker and National Association of Home Builders (NAHB) Chief Economist Robert Dietz predicted continued growth for the construction industry in 2017 during a joint economic forecast today.

OSHA Clarifies Employee Self-Treatment Under Recordkeeping Rule

A recent interpretation letter by the U.S. Department of Labor Occupational Safety and Health Administration (OSHA) has refined the definition of a recordable injury under 29 CFR Part 1904 – Recording and Reporting Occupational Injuries and Illnesses. According to the interpretation, an employee’s self-treatment of wrist pain with a rigid brace qualifies as a reportable injury even if a physician later determines that the brace is acceptable yet unnecessary treatment.

Illinois Governor Vetoes Bill Tying Prevailing Wage To Union Contracts

On July 22, Illinois Gov. Bruce Rauner vetoed a bill that would have significantly changed the prevailing wage calculation process by tying wage rates to union collective bargaining agreements.

Increase in Penalties Begins in August

Due to a provision in the Bipartisan Budget Act of 2015, all agencies with civil monetary penalties covered by the statute have the authority
to raise penalties annually in line with the Consumer Price Index (CPI). Some agencies affected by this increase include DOL, EPA and OSHA. The provision also allows OSHA to have a one-time “catch-up adjustment” in 2016 since the fines have not increased since 1990.
